Overview

To follow please find ninety (90) pages of VERY clear documentation to support my claims of various wrong doings by Professor Elliot (also uses: Elliott) Cramer, the President of FOCAS and PAWS, two nonprofit organizations directly tied to UNC on many levels. I will provide the necessary forms to your organization if so required, e.g., NCSOS. Instead of creating several documents for each entity, please review this single document as I believe it may be helpful to see the broader perspective. This document is long, but it is a very quick read as I converted it to a PDF and highlighted key items to facilitate your review.

Of course, you will also see most of the documentation embedded in this communique. Hence, everything you need is easily accessible for your convenience.

Further, I created a SINGLE highlight page for every organization with detailed comments on Cramer directed specifically to you. I felt it necessary that ALL organizations know of his errs in case you need to discuss this matter between yourselves. I strongly suggest you compare notes with other organizations as there IS overlap on MANY issues. ALL organizations should kindly review ALL 90 pages as there is information laced throughout this document for you all.

Needless to say, I've spent an inordinate amount of time preparing this document. I therefore hope it suffices. If you should require additional material, please contact me.

I trust you ALL take this matter seriously. As my documentation PROVES, Cramer clearly violated North Carolina state law. University guidelines and various Internet terms of service and should therefore be disciplined, arrested and have ALL of his UNC and BellSouth/AT&T internet accounts and emails suspended. I also feel he should be heavily fined by the NC Secretary of State (NCSOS) as he has collected money without a license for FOCAS from 2006 - 2010. Even after being told he needed a license, his website STILL has an ACTIVE paypal / chipin link!! Cramer admitted to me - in writing - he feels he is above the law. See his email to follow. Sadly, he isn't and it's YOUR job to let him know this by enforcing your laws / guidelines.

History

I first emailed Professor Cramer on November 16 when I inquired about his State Solicitation license for his group FOCAS (http://www.friendsofocas.orq/). The reason was simple. FOCAS solicited money for a lawsuit in Robeson NC, though claimed (by both Cramer/FOCAS and the attorney - Galley Gerber from Gerber Animal Law: http://www.animallawnc.com/) the money was "tax deductible" yet they used a UNC email address to channel the money through PayPay / Chipin. AND the website used to channel the money was administered by an official UNC email address under Cramer's name and used UNC's "edu". See below. Last time 1 checked - law firms were NOT tax deductible NOR was UNC!!! At the least, this was a deceptive trade practice and very misleading to ALL donors. Especially since PayPal (Chipin) was NOT designed for laundering of "tax deductible money" through Universities and Law firms!!!!!!!!!!

Upon investigating FOCAS on the NCSOS website (http://www.secretarv.state.nc.us/csl/) I realized FOCAS did NOT have a license since 2006 yet they were promoting solicitations for a plaintiff, Susan Barrett represented by Gerber Animal Law Center, i.e., Barrett & Gerber were raising money for the SOLE intent of paving legal fees THROUGH Cramer's nonprofit, FOCAS. According to the IRS, a law firm should NOT be promoting "tax deductible" collections via a 501c3! Why? This is a deceptive trade practice and it promotes and falsely legitimizes the solicitations via a prominent UNC email address: FOCAS@UNC.com.

Upon further investigating the situation, I realized Cramer spells his first name with One AND TWO T's which is VERY interesting AND his other group, PAWS (http://www.ourpaws.info/), NEVER had a solicitation license. As they have been operational for years, I'm GUESSING they MUST have had some solicitations over the years. If so, these TOO were done outside the NCSOS guidelines! What's also interesting is that BOTH PAWS and FOCAS BOTH use UNC email addresses even though UNC should legally NOT be affiliated with them! Yet the UNC digital fingerprint is ALL over Cramer's websites and emails. It's obvious Cramer is using the good name of UNC to legitimatize his private ventures! As well, Cramer created both websites via a liosting company in Australia. My guess is NONE of this is random. As an aside, after pointing out the ourpawstSjuncedu email address (below) used by Cramer, he eventually removed it from his website! Proof to follow.

In today's age, if FOCAS or PAWS wanted their own branded email, they could easily obtain one without promoting UNC which is NOT a nonprofit and is NOT legally affiliated with FOCAS/PAWS (e.g., PAWS(a),qmail.com).

Upon uncovering and pointing out the above "curiosities", Cramer began his belligerence and lies (see emails in last section). In brief, he claimed FOCAS did NOT require a solicitation license as they were exempt from state law. The reality of the situation (see later documentation) was that HE let his NCSOS's exemption EXPIRE in 2006!! AND according to the NCSOS he needed to renew it YEARLY, but did NOT! (See letter from State confirming this).

This means - in the purest sense - that ALL MONEY raised via solicitations from 2006 - 2010 by FOCAS was done OUTSIDE the laws of NC.

I've read the 27 page NCSOS guidelines, spoke to both Attorney Gardner and Investigator Jacquin, and have documentation below from the NCSOS to substantiate my claims.

About this time, Cramer communicated with Barrett and she, with Gerber. Eventually they exchanged emails /calls and realized they were ALL caught. Ironically, months ago, Gerber stated in an email that she researched the chipin process for raising funds for her lawsuit and concluded she could NOT accept chipin donations! (I am intentionally withholding this "smoking gun" for very good reasons, I DO HAVE THIS EMAIL). Yet somehow she decided to do so through FOCAS. The problem is, FOCAS promoted the fundraising via a very prominent UNC email address (FOCAS@UNC.edu). I do NOT feel any of this was random. In fact, I confronted Gerber/Barrett on this months ago (below) only for my comments to be removed from the Gerber Facebook group page. At this point, Gerber wrote that I am not entitled to question her chipin and I do NOT have ANY First amendment rights to criticize her or her dubious collections. I wish I was kidding. I'm not. See below.

Eventually, Barrett aligned with the Professor and then BARRETT pulled in North Carolina Rottweiler Rescue (NCRR - http://ncrottierescue.net/) where I had fostered a dog. Because there was an existing ownership issue with NCRR, who never paid for any expenses and who also refused to reimburse me for vet fees, etc. - Barrett decided to lure them into the cat fight. It was then THREE (Barrett / Gerber, NCRR, FOCAS) against one. And not one NC Solicitation license in the group!!!!!!!

Ironically, NCRR ALSO had not one, but THREE chipins for Bella. ALL ILLEGAL as NONE were done under a valid NCSOS license. In fact, NCRR actually claimed the dog had a "brain injury" and needed $3,000 for her care. This was a complete lie. The dog only needed training for aggression, antibiotics, deworming and to be spayed. When word leaked out that others had caught on to NCRR's dubious chipin, they created another with a $1,000 goal, and then another where they collected exactly $385 from MY friends!

NCRR pocketed the chipin money and never paid for ANY of the transportation, the vets fees or for training. Not ONE DIME was used for the intended purpose/dog. In total, they made several hundred on the dog and left me high and dry. And YET, after not hearing from them for MONTHS and even after multiple letters to board members requesting their help - NCRR then claimed I was a "dog thief. This was quickly picked up by Cramer who tried to use this against me to "deflect" from his many fundraising errs. What's worse is that then Cramer took the NCRR lies and promoted them on his UNC sanctioned and email administered websites. See the below "Jack Ass" website created by Cramer to use the above NCRR situation to slander me.

Well, this is Cramer's complaint, right? So what - you ask - does this have to do with Cramer? Everything!!!

Cramer joined forces with Barrett and NCRR in an intentional and malicious smear campaign. Why? Thev were ALL CAUGHT soliciting funds throuah chipin WITHOUT a license!!! What's even MORE comedic is that NCRR illegally solicited their funds via a board member who is an employee at Glaxo!!!! I proved this by her email IP address. So JUST as Cramer used UNC to raise funds without a license - so too

did NCRR use a tliird party's computers / networl< to do so!! And I was turned into tlie bad guy for discovering ALL of this.

The rest is history. To follow please find some of Cramer's emails and other documentation. FYI, I WILL be reporting NCRR to the NCSOS and to Sprint for terms of use violations.

I'm hoping this documentation suffices for the NCSOS and paypal to investigate Gerber, Barrett and FOCAS / PAWS / Cramer.

NC Secretary of State

Please note:

1.       FOCAS allowed their exempt license status to expire in 2006. From then until now they raised tens of thousands of dollars.

2.       FOCAS has been told numerous times they need to reapply for their exempt status and yet they have denied needing a license. See multiple emails to support this.

3.       FOCAS raised money through chipin / paypal for the Gerber lawsuit and did NOT have valid license of exemption during this time.

4.       FOCAS also intentionally deceived donors by intentionally setting up a co-branded UNC email address (FOCAStSjUNCedu) to legitimize their fundraising efforts.

5.       FOCAS pushed "traffic" and donors to their website by intentionally using Cramer's UNC website with intentionally provided cross links.

6.       FOCAS violated NOT ONLY ONE NCSOS guideline, but cumulatively scores of them. I've actually highlighted your guidelines and added my notes to them. If you'd like to see my comments please advise. Hence, this is not ONE violation, this is dozens!!

7.       Please pull the last 4 years of 990's from the state and compare to the license status of FOCAS. I'm POSITIVE you will find tens of thousands of dollars raised without a license during these four years.

8.       Please also consider this complaint directed toward PAWS as well. And apply the same request as above for PAWS. They also do not have a license and I'm certain they raised funds over the years.

9.       Please penalize Cramer to the full extent of the law. I know the guidelines cite a max of $10,000 fines for every offense. Since this has been going on for years, I feel he should be fined in the six figure range.

10.    Please also consider court time which is another option cited in your guidelines. I will happily testify to support your case against him.

11.1 feel the Cramer / FOCAS fiasco needs to be made a public case with the maximum legal penalties in order to send a strong message to the animal rescue community that the NCSOS is tough on offenders!

12.    Please also investigate the Gerber law perspective as well. I can provide more information if you wish. Please advise and I will happily provide.

13.    Please investigate PAWS.

14.    Please investigate the above referenced Gerber chipin and any others under her name of "NC Shelter Rescue". Perhaps you could coordinate with PayPal? If so, perhaps contact their compliance department (compliancetajpavpal.com).

15.    Please FULLY investigate NCRR's DOZENS of chipins and especially the three in question for the dog I adopted. Documentation below.

UNC Police and UNC Legal

Please note:

1.       I've already corresponded with both parties, so this is just supplemental details.

2.       I trust this letter will finally effectuate HARSH disciplinary action against Cramer.

3.       Hasn't he embarrassed UNC long enough?

4.       Please deactivate ALL of his email addresses.

5.       Please remove ALL of his UNC websites and cross links to personal affairs.

6.       Please confirm in writing that he will cease and desist.

7.       Please ORDER him to send out a retraction letter that WE PRE-approve to the dozens of animal rights agencies he contacted to slander my person. Need I remind you, this is ALL related to UNC on EVER level, legally and technologically. Hence UNC is NOW liable for Cramer's slander. Please don't make me take action against UNC. I will if I need to. I trust I'm being clear.

8.       Please encourage him to delete the slanderous "Jack Ass" page LINKED to / promoted by his UNC website and created by a UNC email account.

9.       Please review all of the UNC guidelines I've cited and take the appropriate action.

10.    I strongly feel there have been criminal violations here; I will leave that up to you to enforce.

11.1 also strongly feel I deserve an official apology from UNC for NOT acting swiftly and harshly as I requested in November!

12. I also EXPECT a comprehensive status as I still feel the evidence is in my favor that Cramer's UNC digital fingerprint was ALL OVER this case!!

BellSouth and AT&T

Please note:

1.       Please revoke Cramer's access to the Internet, i.e., NOT ONLY his email account, but his actual cable or DSL modem access.

2.       Please terminate his access to ALL internet service effective immediately.

3.       His language, threats, profanity and harassment are ALL violations of your organization's guidelines. I've read same and I'm sure you agree. Please do not hesitate to terminate his account, for life.

4.       Also note, he committed slander, libel and illegally raised funds on YOUR NETWORK. The proof is indisputable. If you doubt me, please contact the NCSOS and request a copy of their investigation which will show that FOCAS did NOT have the necessary license to solicit funds in the state.

5.       If you want, please also contact paypal which I'm certain will ALSO revoke his accounts.

6.       I presently have Cramer blacklisted at the server level. But what's to stop him from creating another BellSouth email account? Nothing, but you!!

7.       Kindly provide a case number and a final disposition on this case.

Hostonce.com Hosting Services

Please note:

1.    I find it MORE than curious that not only does Cramer use two spellings of his name, BUT he also uses an Australian Hosting company for his websites. Is this random? I'm guessing he is intentionally trying to skirt US laws.

2.       Regardless, Cramer violated your guidelines by the "Jack Ass" webpage he created on the OURPAWS.info website on your network.

3.       He also violated NC laws by his illegal fundraising on his FOCAS website that you host.

4.       Please terminate BOTH of his hosting accounts with you IMMEDIATELY!

5.       I cannot stress how much damage this man has created for me. He did not just post a slanderous website on your servers, BUT he used your servers and BellSouth / AT&T network AND UNC networks to actively promote the Jack Ass website to hundreds of my colleagues!

6.       As such, please INSTANTLY revoke his accounts and remove the following web page without hesitation: http://www.ourpaws.info/ioe

7.       Kindly provide a status upon completion of your SHORT investigation.

PayPal / Chipin

Please note:

1.       Please immediately disable ALL of Cramer's paypal accounts.

2.       Please see page one for ALL of his emails, you may want to review all for links to other chipins. Especially the F0CAS(5)UNC.edu account which is the main one in question.

3.       Please investigate this matter and review this document carefully. I feel Cramer should be banned for life from PayPal.

4.       Kindly research the Gerber Animal Law / Susan Barrett chipin by Cramer/FOCAS as I feel it was VERY duplicitous, misleading and frankly illegal.

5.       The FACT the Cramer / FOCAS, Gerber and Barrett all conspired to use FOCAS to raise funds under the UNC name for the FOCAS nonprofit, ONLY TO "LAUNDER" the money and hand it over to an attorney (Gerber) for her client's (Barrett) legal expenses - well, that is NOT the way your service was designed, was it?

6.       Also, they advertised that ALL donations were tax deductible. This is 100% WRONG. Some or ALL MAY BE tax deductible IF the funds REMAINED at the intended cause, FOCAS. This was NOT the case.

7.       Please also investigate the reference "NC Shelter Rescue" chipin by Barrett. I know for a fact she does NOT have a state license to solicit funds and I also know she understands the laws. As such, I've rightfully concluded she, like professor Cramer, feels he is above the law.

8.       Kindly immediately suspend Barrett's NC Shelter Rescue's current chipins (below).

9.       Please also investigate if ourpaws@UNC.edu - Cramer's OTHER nonprofit EVER had a chipin. If they did, it was illegal. PAWS has NEVER had a license.

10.    Please provide SOME feedback to me and inform if I need to provide additional detail on Barrett's NC Shelter Rescue chipins.

11.    PLEASE work with the other agencies here to confirm the FACTS I've provided and to compare notes.

12.    I feel, like the NCSOS, that PayPal needs to send a VERY strong message to the Animal Rights community that such dubious fundraising events will not be tolerated by PayPal. I feel you should make an example out of ALL of the above named. My FACTS and this documentation is VERY clear. Should you need additional material for Gerber, Barrett / NC Shelter Rescue - I will provide.

13.    Frankly, I feel ALL money raised by ALL of the above named scams should be returned to the donors!!

14.    Perhaps you could locate their 990 tax returns like Cramer's, and audit? You will find countless thousands illegal raised.

15.    Please do not hesitate to contact me about the above. My primary concern today is Cramer/FOCAS, though kindly set up investigations for PAWS and Gerber, Barrett and provide the case ID to me.

16.    Lastly, please investigate the referenced NCRR, North Carolina Rottie Rescue. They conducted THREE illegal chipins for the dog I am fostered from them. Not a DIME of the money was applied to the dog/cause in question. The money raised was done so via this email address ncrottierescue@amail.com and the funds were stolen by Diane Sacripanti, the founder of NCRR. They also had a 4* paypal set up on their website BEFORE this dog's and they have a current one now. I'm sure they have ILLEGALLY raised thousands as they ONLY recently obtained a solicitation license. This means for the last SEVEN YEARS (until June or so of this year) - every penny raised through PayPal by NCRR should ALSO be returned to the donors!! http://ncrottierescue.net/
